According to Google the new IT rules of India are not applicable to its search engine

Google has recently expressed that India's new IT rules for digital media are not applicable to its search engine.

The tech giant has urged the Delhi High Court on Wednesday to set aside its single judge order which applied them on the company while dealing with an issue related to removal of offending content from the internet.

The single judge's decision had come while dealing with a matter in which a woman's photographs were uploaded on a pornographic website by some miscreants and despite court orders the content could not be removed in entirety from the World Wide Web and "errant parties merrily continued" to re-post and redirect it to other sites.

A bench of Chief Justice D N Patel and Justice Jyoti Singh issued notice to the Centre, Delhi government, Internet Service Providers Association of India, Facebook, the pornographic site and the woman, on whose plea the single judge's ruling had come, and sought their responses to Google's plea by July 25.

The court said it was not going to issue any interim order at this stage after Google told the bench that it was an intermediary, but not a social media intermediary, and sought protection against any coercive action for non-compliance of the template or guidelines laid down by the single judge.

The global technology giant had also sought removal of the observation by the single judge that it was a social media intermediary.

Google said that the single judge, in his April 20 judgement, "mischaracterised" its search engine as a 'social media intermediary' or 'significant social media intermediary' as provided under the new rules.

It had also said a direction should be issued to the search engine(s) to disabled access to the offending content by 'de-indexing' and 'dereferencing' it in their listed search results and the intermediary ought to comply with such a direction within 24 hours of receiving the same.

The single judge order had also said for a direction to remove or disable access to an offending content to be effective even within India, a search engine must block the search results throughout the world since no purpose would be served by issuing such an order if it has no realistic prospect of preventing irreparable harm to a litigant.

It also directed the police to ensure the offending content was removed and directions were also issued to search engines, like Google, Yahoo and Bing.  It asked search engines to endeavour to use automated tools, to proactively identify and globally disable access to any content which is exactly identical to the offending content, that may appear on any other websites/online platforms. It further stated that if an intermediary fails to fulfil the conditionalities and obligations cast upon it, it was liable to forfeit the exemption from liability available to it under the Information Technology (IT) Act.

Dark mode for Google Maps is Here!

A dark theme is making its way to Google Maps as some users are reporting. Google is rolling out an app-wide dark mode to Google Maps as of version 10.51.1 running on Android 11.

It seems the change is gradually rolling out on the server-side as updating to the latest version of Google Maps is not enough to see the option appear in the app’s settings menu.

The appearance setting in the app will let you force the dark theme indefinitely or match the Android phone universal system theme setting.

There has always been an automatic night-mode that switches on during navigation when the sun goes down if the user is navigating through a tunnel, but it was never applied when browsing maps or menus.

Is anyone else seeing this update on their end? I have not yet seen the change reflect on my OnePlus 8 Pro running the Oxygen OS 11 Open Beta 2. In a Reddit post, at least one person claims to have received Google Maps dark theme and they posted screenshots for proof. You can see it below, where they now have an “Appearance” option in settings that lets them force light or dark themes, or they can let Google Maps listen to whatever the system theme is set at.

Apple & Google’s COVID-19 tracing tech saved thousands of lives in UK

Apple and Google joined hands to develop the Exposure Notifications System to contact trace and alert users about possible COVID-19 exposure.

The API was introduced in June 2020 and the contact tracing app has saved a great deal of lives in the UK. According to a report the contact tracing tech has saved lives of between 42000 and 8700 users in the UK.

The main purpose of the contact tracing technology by Google and Apple helps public health authorities to contact and guide anyone who may have been exposed to a person who has contracted the virus.

According to Google traditional methods of contact tracing are critical to containing the spread of the infection.

We can use the advanced technology to support and augment these efforts by allowing public health authorities to quickly notify people who may have been exposed to the virus.

With the recent situations with the suffering of COVID-19 victims and casualties, Nepal could also benefit greatly from this technology.

Concerned authorities must put their efforts into being the tech to our country to fight the horrible scenario.

Google to comply with India's new IT rules

Google, assures compliance with India's new IT rules, on Wednesday, said it will continue to build on its existing approaches and keep the policies as transparent as possible.

The company was responding to the Centre's new IT rules, which will come into effect from today. Google spokesperson in a statement said, "We realise that our work in keeping our platforms secure is never done and we will continue to refine our existing approaches, and evolve our policies and be as transparent as possible about how we make decisions." It further cited its 'long history' of managing content according to local laws to assure the Indian government of its continuing efforts to ensure legal compliance.

"We respect India's legislative process and have a long history of responding to government requests to remove content where the content violates the local law or our product policies. We have consistently invested in significant product changes, resources, and personnel to ensure that we're combating illegal content in an effective and fair way, and in order to comply with local laws in the jurisdictions that we operate in," it added.

On February 25, the Centre framed the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules 2021, in the exercise of powers under section 87 (2) of the Information Technology Act, 2000 and in supersession of the earlier Information Technology (Intermediary Guidelines) Rules 2011, which will come into effect from May 26. The new guidelines issued by the government of India mandated a grievance redressal system for over the top (OTT) and digital portals in the country.

Under the new rules, social media platforms will have to have a grievance redressal mechanism, they will also have to name a grievance officer who shall register the grievance within 24 hours and dispose of it in 15 days. The government had said that if there are complaints against the dignity of users, particularly women - about exposed private parts of individuals or nudity or sexual act or impersonation, etc - social media platforms will be required to remove that within 24 hours after a complaint is made.

As per the guidelines, first, the social media platforms will have to have a chief compliance officer residing in India responsible for ensuring compliance with the act and the rules. Second is a nodal contact person who should reside in India for 24X7 coordination with law enforcement agencies. Also, social media platforms have to appoint a resident grievance officer who shall perform the grievance redressal mechanism as indicated. They also will have to publish a monthly report about the number of complaints received and the status of redressal.
